Traffic fines: does employer pay when unclear?

Companies may soon pay traffic fines if it is not clear which employee was driving the fined company vehicle. Thanks to the driver identification-solution from All-Connects, on the other hand, you always know which of your staff was at the wheel at what time.

What exactly does the legislation say?

With cars owned by legal entities - that is, company cars - it is sometimes difficult to determine exactly who is responsible for a traffic violation. Often, the employee who committed the violation does not come forward to admit his or her mistake.

To ensure that traffic fines are always paid, Mobility Minister François Bellot introduced a new bill. If the identity of the offender is unclear, the bill will be presented to the company.

Thus, this measure came about specifically in situations where company cars are often used by different employees. Think of vans, trucks, and so on. Indeed, for company cars with a regular driver, this measure has been in place for several years.

Yet the bill is also receiving headwinds. For example, certain employer organizations believe it makes more sense to make driver identification mandatory. That way you know at all times exactly which employee was driving a particular company car. And that's where All-Connects offers the solution.

How does All-Connects' driver identification solution work?

All-Connects equips your company cars with a system to identify driver (and possibly passengers). This requires the employee to use a personal badge. Thus, the employee's identity is automatically registered by the system.

And it doesn't stop there. Employers can view the recorded data in real time at any time via an application on their smartphone or tablet. The app even records the exact time when employees unlock or lock the cars.

The driver identification system thus ensures that there can no longer be any discussion about who is responsible for a traffic violation.

Driving behavior analysis

The system goes even one step further. The employee can no longer come up with excuses about the cause of the traffic fine. Does the driver claim he doesn't normally drive this fast? And that it was a one-time mistake?

Well, then from now on the employer can easily analyze the driving behavior of this driver. In fact, the app records whether the s/he is speeding, accelerating too violently or taking too sharp turns. Every action of the employee is recorded by the system.

It is also possible for the system to alert the driver to risky driving behavior while driving. If the employee exceeds a certain parameter, the he/she receives an alert in real time. Getting these small alerts in the moment reduces the risk of traffic violations and accidents.
